Lexmark firmware update locks our cartridges

The latest Lexmark firmware update locks out third-party remanufactured cartridges.

Lexmark released a firmware update on 1 June 2023 for the CX421 printers that are equipped with advanced technical protective measures to enforce the terms of the Lexmark Return Programme Agreement and prevent the use of counterfeit or unauthorised cartridges.

According to Lexmark, if a third-party cartridge is detected, the printer may be disabled. Lexmark Return Programme cartridges are sold at a discount and are intended for one-time use, while Lexmark Regular cartridges can be refilled or remanufactured.

Firmware updates may maintain the effectiveness of the protective measures, potentially disabling third-party cartridges that previously worked. Lexmark does not remove or roll back firmware, as it is necessary for the printer to function.

According to Lexmark, the U.S. Supreme Court ruling primarily addressed post-sale enforcement of patent rights, it did not impact the enforceability of contractual restrictions such as those in the Return Programme Agreement.
