The OEM has filed two more Report Infringement Forms with Amazon UK and has obtained a preliminary injunction in the District Court Düsseldorf.
In the latest legal twists involving Canon Inc., the company has announced that the District Court Düsseldorf has granted the OEM a preliminary injunction against Idem Rebuilding Di Carbonara Giuseppe, trading as “Universocartuccia”.
The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407 relating to a drum unit and a process cartridge.
The preliminary injunction, which is not final and can be appealed, enjoins Idem Rebuilding Di Carbonara Giuseppe from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, e.g. via www.amazon.de. The infringing cartridges can replace the OEM cartridge models HP CE505A, HP CE505X, HP CF280A and HP CF280X, which are compatible with HP laser beam printers.
Canon has also announced the filing of a Report Infringement Form with Amazon UK based on the alleged use of claim 1 and 25 of the UK portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by Home Media Online Composite Containers Ltd. under the ASIN B00BOS4R92.
Afterwards, Amazon took down the respective product. This product is compatible with the OEM HP cartridge model CE505X and comprises a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.
A form was also filed with Amazon UK regarding the cartridge model “CE505X” offered by Techtopium Taiwan Ecolink International Co. Ltd. under the ASIN (Amazon Standard Identification Number) B07F27BRXG.
Amazon removed the respective product, which is compatible with the OEM HP cartridge model CE505X and features a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.
Amazon informed the vendors, both of whom can object.
