Skyward shipment violates exclusion order.
The United States International Trade Commission (USITC) has issued a seizure and forfeiture order against Skyward Industry Inc., based in Cheyenne, Wyoming, after the company attempted to import toner cartridges in violation by an existing General Exclusion Order (GEO).
The order, issued under Section 337(i) of the Tariff Act of 1930, follows a report from U.S. Customs and Border Protection (CBP) that Skyward imported goods infringing the USITC’s prior ruling in Investigation No. 337-TA-1174.
The infringing products were denied entry and have been seized and forfeited to the United States. The GEO remains in effect and prohibits the importation of covered products by any party.
The original investigation was brought by Brother Industries, Ltd., Brother International Corporation (U.S.A.), and Brother Industries (U.S.A.), who successfully argued that the products violated their intellectual property rights.
The seizure order, dated 8 May 2025, applies to Skyward Industry Inc. and any affiliated or successor entities.
