Trade body launches probe into imported ink cartridges after Japanese firm’s complaints.
The US International Trade Commission has formally launched two investigations into the alleged infringement of Epson’s ink cartridge patents, following complaints filed last month by the Japanese manufacturer and its subsidiaries.
The proceedings, initiated under Section 337 of the Tariff Act, target a broad group of China- and Hong Kong-based manufacturers, alongside two US resellers. The complainants—Seiko Epson Corporation, Epson America Inc, and Epson Portland Inc—seek general exclusion orders to block infringing cartridges from entering the US market, as well as cease-and-desist orders.
USITC Investigation No. 337-TA-1451 names respondents including 3G Supplies (HK), Aomya Printer Consumables, Cartridge Evolution, Ejet Technology, Zinyaw, and V4INK. Investigation No. 337-TA-1452 lists similar overseas suppliers plus California-based Imaging Supplies Technology and Internet Ink of Illinois.
The investigations will now proceed before an administrative law judge, who will schedule hearings and make an initial determination. A target date for conclusion must be set within 45 days of the announcement.
The USITC clarified that its decision to institute investigations “does not imply a ruling on the merits”. However, it underscores the commission’s willingness to consider Epson’s claims of widespread intellectual property violations in the imaging aftermarket.
If upheld, the complaints could lead to exclusion orders and cease-and-desist orders.
