Ricoh sues OneSource over unpaid services

The company alleges non-payment for services and claims breach of contract and damages.

Ricoh USA, the American arm of the Japanese multinational imaging and electronics firm, is suing Illinois-based One2One Communications (trading as OneSource), in a dispute over outstanding payments for maintenance services provided to its high-performance IP5000 Print System.

The case, filed in the United States District Court for the Northern District of Illinois, centres on unpaid invoices amounting to over $120,000 (€112,973), which Ricoh claims OneSource refused to settle despite receiving services for over 15 years.

The legal battle originates from a 2008 purchase by OneSource of Ricoh’s IP5000 continuous inkjet printer, a system praised for handling high volumes in sectors like direct mail and commercial printing. Despite this, Ricoh alleges that OneSource’s use of non-Ricoh ink caused significant damage to the printer several years ago. Ricoh, nonetheless, absorbed a $60,000 (€56,487) repair cost to keep the print system operational but has now drawn the line after the most recent breakdown in payment negotiations.

According to Ricoh’s filings, OneSource halted payments in April 2023, claiming dissatisfaction with the printer’s performance, even while print volumes reportedly remained stable. Despite Ricoh’s efforts, including deploying senior engineers and undertaking extensive repairs and upgrades, OneSource withheld payments, insisting the equipment was not working “as advertised.”

The complaint further alleges that OneSource ignored explicit contractual obligations, with Ricoh stating it repeatedly informed OneSource of operating guidelines and restrictions. “Ricoh has satisfied all conditions,” the company claims, citing a contract clause that limits Ricoh’s liability for failures due to improper usage by clients.

Ricoh’s legal team argues that OneSource’s actions constitute both breach of contract and unjust enrichment. In addition to the outstanding balance, Ricoh seeks pre- and post-judgment interest, costs, and legal fees.
