The United States International Trade Commission (USITC) voted to institute an investigation of certain toner cartridges, components thereof, and systems containing same based on the complaint filed by Brother on 19 August.
The investigation is based on the complaint filed by Brother Industries, Ltd., of Aichi-ken, Japan; Brother International Corporation (U.S.A.) of Bridgewater, NJ; and Brother Industries (U.S.A.), Inc., of Bartlett, TN, on 19 August 2019.
The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain toner cartridges, components thereof, and systems containing same that infringe patents asserted by the complainants. The complainants request that the USITC issue a general exclusion order, or in the alternative a limited exclusion order, and cease and desist orders.
Aster Graphics Inc. now filed a Protective Order to ensure that information submitted in response to the request for information and throughout this investigation or other proceeding may be disclosed to and used confidentially.
Brother and OW Supplies have jointly filed a motion to terminate the Investigation as to OW Supplies based on the entry of a Consent Order. With this order OW Supplies agrees to not sell or import any of the allegedly infringed products and any stock that has been kept shall be destroyed within 30 days of the Order coming into effect.
