More removals and injunctions for Canon

Canon reported that it had obtained a preliminary injunction as well as more Amazon takedowns on Amazon.it, Amazon.de and Amazon.co.uk.
The first announcement was that Canon was granted a preliminary injunction against Reporta Spain SL, doing business as “Key Componentes,” as well as against its managing director from the District Court Düsseldorf.
The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407 relating to a drum unit and a process cartridge. The preliminary injunction enjoins Reporta Spain SL from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, via, for example, www.amazon.de and www.keycomponentes.com. The infringing cartridges can replace the OEM cartridge model HP CF280A, which is compatible with HP laser beam printers.
Defendants have the option to file an objection against the preliminary injunction. However, as service on Defendants was affected, Canon can enforce this decision.
Canon also announced it had requested removals for toner cartridges offered by ANYPRINTER SRL from Amazon.it alleging the use of claim 1 and 25 of the Italian portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by ANYPRINTER SRL under the ASIN (Amazon Standard Identification Number) B008FWP2DA.
Afterwards, Amazon took down the respective products. These products are compatible with the OEM HP cartridge model CE505X and provide inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.
Filing a Report Infringement Form with Amazon.de Canon alleged use of claims 1 and 2 of the German portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge models “CB540A,” “CB541A,” “CB542A,” “CB543A,” “CE320A,” “CE321A,” “CE322A” and “CE323A” offered by VENUE DESIGN & CONSULTING SRL-D under the ASINs (Amazon Standard Identification Number) B07F85P1H6, B078GYMSZ3, B078GRTSP9, B07DNG7JX5, B07DXWRCX9, B07DNFWWJ4, B07DNFX4W9 and B07DNF6G7N.
Afterwards, Amazon took down the respective products. These products are compatible with “CB540A,” “CB541A,” “CB542A,” “CB543A,” “CE320A,” “CE321A,” “CE322A,” and “CE323A”, and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.
Two further infringement forms were filed with Amazon UK, with the first based on the alleged use of claim 1 and 25 of the UK portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by Toner and Inks under the ASIN (Amazon Standard Identification Number) B00PS4K6YS.
Afterwards, Amazon took down the respective product. This product is compatible with the OEM HP cartridge model CE505X and provides inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.
The second is based on the alleged use of claim 1 of the UK portion of Canon’s European Patent EP 2 087 407 regarding the drum unit models “CE505A,” “CF280A,” “CRG719,” “CE255A” and “CE255X” offered by Badger Inks Ltd under the ASINs (Amazon Standard Identification Numbers) B0179ZNBWM, B0179ZNAKO, B01789GUJO and B00OQAWYJA.
Afterwards, Amazon took down the respective products. These products are compatible with the drum unit of the OEM HP cartridge models CE505A, CF280A, CRG719, CE255A and CE255X, and provide inter alia a non-OEM coupling member and a non-OEM drum.
