Konica Minolta faces class action lawsuit

Konica Minolta Business Solutions is facing a class action lawsuit alleging violations of American labour laws over unpaid overtime for its IT Systems Engineers.
The case, filed in New Jersey’s federal court, accuses the company of failing to compensate employees adequately for on-call duties, which reportedly included working nights and weekends and responding to customer issues within strict timeframes. Lead plaintiff Alexandre Marquinhos, who worked for Konica Minolta from 2013 to March 2024, claims the company’s practices breached both the Fair Labor Standards Act (FLSA) and the New Jersey Wage and Hour Law (NJWHL).
The lawsuit centres on the company’s “All Covered Assurance” programme, which offers 24/7 IT support to small and medium-sized enterprises across the US. Marquinhos alleges he and his colleagues were required to remain on-call for up to two weeks at a time, alternating between primary and secondary roles. On-call staff were expected to respond to issues within ten minutes, often working more than 40 hours a week, but were allegedly not paid overtime wages for the additional hours worked.
The legal team representing Marquinhos is seeking certification for both a nationwide collective action under the FLSA and a New Jersey-specific class action under the NJWHL. The lawsuit claims Konica Minolta’s actions violated labour regulations by failing to record and compensate for the full scope of employees’ work.
