India to impose anti-dumping toner tariffs

Initial findings confirm that toner made or exported from China, Malaysia and Taiwan into India is causing injury to the domestic industry and recommends the imposition of the anti-dumping duties.

In the preliminary findings published on 18 June 2020, the Directorate of Trade Remedies, part of the Ministry of Commerce and Industry found that the product under consideration is being dumped into India from subject countries. The margins of dumping from each of the subject countries are more than the de minims limits prescribed under the rules.

The anti-dumping investigation into the exporting of black toner powder from China, Malaysia and Taiwan was launched by India’s Directorate General of Trade Remedies in February 2020, following a joint complaint from India’s two main toner manufacturers, Indian Toners and Developers Ltd and Pure Toners and Developers Pvt. Ltd who requested the imposition of anti-dumping duty on the imports.

The companies at the centre of the investigation are:

  • Hubei Far East, China PR
  • Wuhan Point Role, China PR
  • Handan Hangguang, China PR
  • wuxi jiatieng, China PR
  • Dinglong, China PR
  • Nanjing Teshine, China PR
  • Comet, China PR
  • Wuhan Techwin Toner and Developer Limited, China PR
  • Jadi, Malaysia
  • TTI, Chinese Taipei

The investigation found that over the period investigated toner imported from China and Taiwan undercut the domestic market between 0% and 20%. Whereas toner imported from Malaysia undercut the domestic market between 40% and 60%.

The Authority recommends imposition of provisional anti-dumping duty equal to the lesser of margin of dumping and the margin of injury, so as to remove the injury to the Domestic Industry.

The provisional rates for Black Toner in Powder Form are:

  • China, $834 / €743 per metric tonne
  • Malaysia, $1,686 / €1,503 per metric tonne
  • Taiwan, $196 / €175 per metric tonne

The anti-dumping duty is subject to confirmation by the Ministry of Finance.
