HP “monopolise the HP inkJet cartridge aftermarket”
April 19, 2022
In a new class action lawsuit HP is accused of locking out competitors and monopolising the inkjet cartridge market and the complainant is seeking that HP be required to” reverse the effects of its malware transmissions insofar as they render once-compatible third-party cartridges obsolete”.
The Class Action Complaint was filed by Henry So, individually and on behalf of all other similarly situated individuals against HP Inc. and its use of firmware to stop third party supplies from working in its printers.
In the Complaint, Henry So alleges that HP is locking out its competitors “by transmitting firmware updates without authorisation to HP printers over the Internet”. The allegation calls the firmware updates “malicious firmware updates” that render third-party supplies incompatible.
Henry So added in his Complaint that “HP has marketed and sold its standard HP printers as capable of printing using HP Original Supplies as well as refilled or third-party cartridges” which he claims in his Complaint, are not working once the firmware updates have happened.
As part of the evidence, Henry So says that HP is taking the consumers choice to use third party supplies and alleges that it is part of “HP’s new strategy to monopolise the HP inkJet cartridge aftermarket”.
Henry So is demanding trial by jury and is asking for an injunction “requiring Defendant to cease the unlawful business practices described herein and otherwise protecting the interests of Plaintiff and the Classes, including requiring HP to reverse the effects of its malware transmissions insofar as they render once-compatible third-party cartridges obsolete”.
