HP faces another Class Action Complaint

HP faces another class action complaint in the US courts concerning the failure of HP All-in-One inkjet printers will not scan or fax if a single ink cartridge is too low or empty.

The class action complaint was filed by California based, Gary Freund and Minnesota based, Wayne McMath, individually and on behalf of others, alleging that HP is misleading its customers when HP fails to disclose an alleged design flaw that disables the scanning and, if included, the fax function if a single ink cartridge is too low or empty and “Purchasers of HP All-in-One Printers have been harmed” as a result of purchasing a device.”

The complaint is linked to HP’s Envy 6455e All-in-One Wireless Color Printer and HP Deskjet 2655 All-in-One Compact Printer where the plaintiffs are further asserting that “HP’s design of its All-In-One inkjet printers is intended to increase ink sales”, since they believe “there is no legitimate purpose for selling the All-In-One Printers with scanning or faxing functionality that is directly tied to the existence or level of ink contained in the devices.”

The class action complaint against HP Inc, was filed in the United States District Court Northern District of California and the plaintiffs are seeking trial by jury and requesting compensatory and statutory damages (including punitive damages).
