German Amazon seller sues HP for damages

In a significant legal confrontation, German entrepreneur Emek Ersoysal has filed a lawsuit against American technology giant HP, Inc., accusing the company of unfair business practices and seeking substantial damages. The case, lodged in the United States District Court for the Northern District of California, outlines multiple grievances against HP, including allegations of tortious interference with existing and prospective business relationships.
Ersoysal, the operator of the Amazon.de seller account Buyingshops, claims that HP’s unfounded counterfeit accusations led to the suspension of his Amazon.de listings. The complaint states that Ersoysal purchased authentic HP-branded products from an authorised reseller in Turkey and listed them on Amazon’s German marketplace without altering the packaging. Despite providing evidence of the product’s authenticity, HP’s intellectual property agents refused to retract the counterfeit claims, severely impacting Ersoysal’s business operations and potentially setting a dangerous precedent for other e-commerce sellers.
The lawsuit details the profound financial and psychological toll on Ersoysal due to HP’s actions. His revenue from Amazon sales, which had been steadily increasing, plummeted following the suspension, pushing him to the brink of bankruptcy. Ersoysal alleges that HP’s interference not only disrupted his income stream but also caused severe stress and anxiety, leading to social isolation and strained family relations.
Ersoysal’s legal team, led by attorney Yakup Sari, argues that HP’s conduct was malicious and oppressive, warranting punitive damages. The complaint includes five specific claims for relief: a declaratory judgment of non-infringement, tortious interference with contract, tortious interference with prospective business relations, negligent interference with prospective economic advantage, and unfair business practices. These claims form the basis of Ersoysal’s case against HP.
The case highlights the growing tensions between multinational corporations and smaller independent sellers in the digital marketplace, and the outcome of this lawsuit could set a significant precedent for future disputes involving trademark allegations and business interference on e-commerce platforms.
