EU modernises product liability rules, targeting digital innovations and circular economy adaptations.
The European Union has introduced sweeping changes to its product liability regulations, adapting its framework for the digital age and the burgeoning circular economy. Approved on Monday, the revised rules expand the scope of liability to include software, digital manufacturing files, and modified products.
This landmark reform marks a decisive shift in how liability is attributed in an increasingly interconnected and sustainable marketplace. Manufacturers and platforms will now face clearer accountability for defects, even in intangible digital components. Under the updated directive, online marketplaces acting as economic operators may also be held liable for defective goods sold on their platforms.
The directive also aims to simplify the legal process for consumers seeking redress. By encompassing software-driven issues and clarifying platform responsibilities, it reduces ambiguity for users navigating claims for defective products.
Member states must transpose the directive into national legislation by December 2026, setting the stage for a pan-European shift in liability norms.
