Canon wins preliminary injunction in Düsseldorf

The OEM has been granted a preliminary injunction against Grey Systems GmbH and its managing directors by the District Court Düsseldorf.
Once again, Canon is hitting headlines with another patent infringement lawsuit, this time based in Germany, with the OEM announcing this week that it has been granted a preliminary injunction against Grey Systems GmbH.
The injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407, relating to a drum unit and a process cartridge.
The preliminary injunction, which is not final and can be appealed, enjoins Grey Systems GmbH from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, e.g. via the online shop www.dulin-shop.com.
The infringing cartridges can replace the OEM cartridge models HP CE505X, HP CE255A, HP CE255X and HP CF280X compatible with various models of HP laser beam printers.
According to the OEM, the preliminary injunction also contains a claim for sequestration; as a result, the infringing cartridges have been handed over to a bailiff until the matter is finally solved.
The defendants have the option to file an objection against the preliminary injunction. However, Canon revealed that, “as service on Defendants was effected, Canon can enforce this decision.”
This lawsuit is the latest in a long line of lawsuits notched up by the OEM in recent months, both in the USA and further afield.
