Canon wins out in Russian Court of Appeal

Canon Inc. has announced that a decision of the Moscow Arbitration Court favouring the OEM was upheld by the Ninth Arbitration Court of Appeal in a toner-cartridge-related infringement lawsuit in Russia.

Canon filed a patent infringement lawsuit with the Moscow Arbitration Court against the defendants LLC VTT and LLC Pallady asserting that defendants’ sales of certain toner cartridges infringe Canon’s Russian Federation patent 2467370.

On 31 January 2019, the Moscow Arbitration Court issued the decision in favour of Canon which, among others, permanently enjoins the defendants from selling the products found to infringe, and awards Canon a total of 4 million rubles ($61,723/€55,399) in compensation.

The defendants responded by filing appeals against the decision of the Moscow Arbitration Court to the Ninth Arbitration Court of Appeal.

On 17 April 2019, the Ninth Arbitration Court of Appeal decided to uphold the decision. The defendants have the option to file a further appeal to the Court on Intellectual Property Rights.

This isn’t the first such case in Russia that Canon has been involved in. The company launched an IP case against OOO “Softtrade” in 2014, also regarding the infringement of its Russian Federation patent 2467370, a lawsuit which Canon finally won in October 2015.
