Canon finishes the week with more removal requests

The OEM requested removal of toner cartridges offered by Cartridge Sale from Amazon Australia offered by zhuhai hezhong maoyi youxian gongsi via Amazon UK, Germany and Italy and offered by Go4Color from Amazon.com.

Canon announced the filing of a Report Infringement Form with Amazon Australia based on the alleged infringement of claim 160 of Canon’s Australian Patent Number AU2014208277 regarding the cartridge models CE505A and CF280A offered by Cartridge Sale under the ASINs (Amazon Standard Identification Numbers) B00ZQSSLV6 and B00KHZW4W0.

After receipt of the Report Infringement Form, Amazon took down the respective products. These products are compatible with the OEM HP cartridge models and provide a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Canon also announced that it filed Report Infringement Forms with Amazon.de, Amazon.co.uk, Amazon.it and Amazon.es based on the alleged use of claims 1 and 2 of the Germany, UK, Italian and Spanish portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding certain models of toner cartridges offered by zhuhai hezhong maoyi youxian gongsi under the following ASINs (Amazon Standard Identification Numbers – see Table 1).

Afterwards, Amazon took down the respective products. These products are compatible with the OEM HP cartridge models and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.

The OEM announced the filing of an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by Go4Color for use in HP laser beam printers.

Canon’s infringement report alleged that certain model HP 126A toner cartridges sold by Go4Color via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008.
