Canon continues to file Report Infringement Forms

The OEM announced it requested removal of toner cartridges from Amazon Germany, Mexico and Canada.

Afterwards, Amazon took down the respective products. These products are compatible with the above OEM HP cartridge models CC530A, CC531A, CC532A, CC533A, CE410A, CE411A, CE412A, CE413A, CB540A, CB541A ,CB542A, CB543A, CE320A, CE321A, CE322A and CE323A, and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.
Canon also announced the filing of an infringement report with Amazon.mx seeking the removal of Amazon.mx listings for certain toner cartridges sold by JinNiuQuHeHaiRongRiYongPinJingYingBu for use in HP laser beam printers.
Canon’s infringement report alleged that claim 65 of Mexican Patent Number 317598 was infringed by certain models CC530A, CC531A, CC532A and CC533A toner cartridges offered by JinNiuQuHeHaiRongRiYongPinJingYingBu under the Amazon Standard Identification Numbers (ASINs) B07VBMLDHG, B07XRH8BNR, B07XC735D7, B07XRPMBJN and B07VDQY24Z.
After receiving Canon’s Report Infringement Form, Amazon removed the respective products, and at the time of this announcement, the above-identified listings of JinNiuQuHeHaiRongRiYongPinJingYingBu were no longer available on Amazon.mx.
The OEM also filed an infringement report with Amazon.ca seeking the removal of an Amazon.ca listing for certain toner cartridges sold by HEHAIRIYONGPIN.
Canon’s infringement report alleged that certain model CB540A, CB541A, CB542A, CB543A, CE320A, CE321A, CE322A, CE323A, CE410A, CE411A, CE412A, CE413A, CF210A, CF211A, CF212A and CF213A toner cartridges sold by HEHAIRIYONGPIN – Canada via Amazon.ca infringed Canon’s Canadian Patent no. 2,635,791.
