Canon continues to defend its IP

The company has announced the conclusion of its dispute with Bublat GmbH & Co. KG and its managing directors as well as requesting more Amazon removals.
Canon announced that it signed a settlement agreement with Bublat GmbH & Co. KG and its managing directors in order to resolve their patent dispute regarding Canon’s European Patent EP 1 977 289 B1 (“EP ‘289”).
The matter at issue concerns the offering and distribution of certain laser toner cartridges by Bublat GmbH & Co. KG, via, for example, www.amazon.de and www.druckerpatronenexpress.de.
The settlement agreement inter alia includes a Europe-wide cease-and-desist declaration, whereupon Bublat GmbH & Co. KG and its managing directors are prohibited from making, offering, putting into circulation and/or importing and/or possessing certain laser toner cartridges that infringe claim 1 and 2 of EP ‘289 in all countries where EP 1 977 ‘289 B1 is valid and in force.
The cartridges at issue include a developing unit moveable relative to the drum unit when receiving force via a force receiving device. The respective cartridges can replace the OEM cartridge models HP CE320A, HP CE322A and HP CE323A which are compatible with HP laser beam printers.
Furthermore, Bublat GmbH & Co. KG as well as its managing directors have agreed to pay damages for past infringement to Canon. Further details of the settlement agreement are confidential.
Canon also announced the filing of an infringement report with Amazon.ca seeking removal of an Amazon.ca listing for certain toner cartridges sold by Ecshub.
Canon’s infringement report alleged that certain model CB540A, CB541A, CB542A and CB543A toner cartridges sold by Ecshub via Amazon.ca infringed Canon’s Canadian Patent no. 2,635,791. Canon requested the removal of the corresponding listings for these products, having Amazon Standard Identification Numbers B07PPPGXFF, B07PQSWWRK, B07PML64HR, B07PPPDV4G and B07PRYM8YJ.
At the time of this announcement, products sold under the above-identified listings were no longer available on Amazon.ca.
Amazon.com received an infringement report from Canon, seeking removal of Amazon.com listings for certain toner cartridges sold by zhongshancaipin for use in HP laser beam printers.
Canon’s infringement report alleged that certain model CF360A, CF361A, CF362A and CF363A toner cartridges sold by zhongshancaipin via Amazon.com infringed Canon’s U.S. Patent No. 9,581,958. Canon requested that Amazon remove zhongshancaipin’s listings for those products, namely, zhongshancaipin’s listings with Amazon Standard Identification Numbers (“ASINs”) B07ZY5KKCL, B07ZY5QRB3, B07ZY61SBV, B07ZY5WK6G, B07ZY6CHXK, B07ZY61H38, B07ZY6FP4B, B07ZY5SLH7 and B07ZY66H6N.
At the time of this announcement, the above-identified zhongshancaipin listings were no longer available on Amazon.com.
