Canon announces win in patent infringement case

The OEM announced judgement of acceptance against Doree Supplies B.V. and its Managing Director of District Court Düsseldorf as well as more Amazon removal requests.
Canon Inc. announced that the District Court Düsseldorf issued a judgement of acceptance (docket no. 4a O 35/19) in the patent infringement proceedings against the Dutch-based company Doree Supplies B. V., doing business as “Appletoner,” and its managing director after Defendants acknowledged all claims asserted by Canon.
The decision is based on infringement of the German portion of Canon’s European Patent EP 1 977 289 B1 (in the following: “EP ‘289”) and concerns the offering and distribution of certain laser toner cartridges including a developing unit moveable relative to the drum unit when receiving force via a force receiving device through, inter alia, www.amazon.de.
According to the decision, Doree Supplies B. V. as well as its managing director are, inter alia, enjoined from offering for sale and distributing certain laser toner cartridges that make use of EP ‘289 and, furthermore, paid damages to Canon Inc.
The cartridges at issue can replace the OEM cartridge models HP CC530A, HP CC531A, HP CC532A, HP CC533A, HP CB540A, HP CB541A, HP CB542A and HP CB543A which are compatible with HP laser beam printers.
Also active in Turkey again, the company announced the filing of a Report Infringement Form with Amazon.com.tr based on the alleged use of claims 1 and 25 of the Turkish portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model CF226X offered by MS BILGISAYAR LIMITED SIRKETI under the ASIN (Amazon Standard Identification Number) B01NB0ZEKP.
Afterwards, Amazon took down the respective product. This product is compatible with the OEM HP cartridge model and provides inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.
Amazon informed the vendor about the takedown request and the vendor may object to it.
Also announced was the filing of an infringement report with Amazon.com seeking the removal of Amazon.com listings for certain toner cartridges sold by JSL GO for use in HP laser beam printers.
Canon’s infringement report alleged that certain model HP CE310A, CE311A, CE312A, CE313A, CF350A, CF351A, CF352A and CF353A toner cartridges sold by JSL GO via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove JSL GO’s listings for those products, namely, JSL GO’s listings with Amazon Standard Identification Numbers (“ASINs”) B06ZZJ18DZ, B06ZZSJ5LS, B06ZYN1JCV, B06ZYCLY1V, B071CQFPJ2, B06XVMJYHS, B06ZZHT19K, B071CQFQGQ, B06ZZ7D2GN, B06XVLYQM9, B06ZY32YYZ, B06XVNF6SV, B06ZYN5QCJ, B06XVMB5ZP, B06ZZSFHNM, B06ZXSLKT5, B06ZXSLDS7, B06ZZ7DQXP, B06XVM53S3, B06XVLLLSM, B06XVCV9XT, B06XVHNRB8 and B01L169C78.
At the time of this announcement, the above-identified JSL GO listings were no longer available on Amazon.com.
Canon added that it remains committed to pursuing legal enforcement against those who do not respect Canon’s intellectual property.
