Aug 16, 2023 | 0 comments

Print-Rite has acknowledged the alleged infringement of the patent dispute and has entered int a Consent Judgment and Permanent Injunction from the Delaware court.

Canon and Print-Rite have agreed to resolve their pending disputes in the U.S. District Court for the District of Delaware and the District Court of Düsseldorf in Germany against Print-Rite in which Canon alleged infringement of U.S. Patent No. 11,169,483 and corresponding European Patent No.3 470 931, respectively.

To resolve these matters, Print-Rite has acknowledged that it infringed the above-mentioned patents and agreed to stipulate to a Consent Judgment and Permanent Injunction from the Delaware court, as well as the issuance of a Judgment of Acknowledgement from the Dusseldorf court acknowledging all claims asserted by Canon as justified in whole.

As a result, Print-Rite is prohibited from making, using, selling, and offering for sale in the U.S. and Germany, and from importing into those countries, the toner cartridges that Canon accused of infringement, including but not limited to Print-Rite models CF248A and CF244A.

In addition, Print-Rite has agreed to pay an undisclosed amount to compensate Canon for its infringement.

Further details of the settlement are confidential.
