Canon and Print-klex sign another settlement agreement

The OEM announced the conclusion of its dispute with Print-klex GmbH & Co. KG and its managing director.
Canon Inc. and Print-klex GmbH & Co. KG, doing business as “Print-klex” and “123 color”, as well as its managing director, agreed to resolve their pending patent infringement litigation (docket no. 4a O 1/20) based on EP 1 977 289 (in the following: “EP ‘289”) by signing a settlement agreement. The litigation is based on infringement of the German portion of Canon’s EP ‘289 and concerns the offering and distribution of certain laser toner cartridges through https://print-klex.de, www.ebay.de and www.amazon.de. The infringing cartridges include a developing unit moveable relative to the drum unit when receiving force via a force receiving device.
According to the settlement agreement, Print-klex as well as its managing director have agreed to, inter alia, refrain from offering for sale and distributing certain laser toner cartridges that make use of EP ‘289 and, furthermore, pay damages for past infringement to Canon Inc. The cartridges at issue can replace the OEM cartridge models HP CF210X, HP CB540A, HP CE320A, HP CC530A, HP CC531A, HP CC532A, HP CC533A, HP CE410X, HP CE411A, HP CE412A, HP CE413A, HP CF380X, HP CF381A, HP CF381A and HP CF381A which are compatible with HP laser beam printers.

Last week, Canon and Print-klex agreed to resolve their pending patent infringement litigation based on EP 2 087 407 (“EP ‘407”) by signing a settlement agreement. The cartridges at issue in this case can replace the OEM cartridge models HP CF226X and HP CF287A.
