Canon amplifies its patent infringement protection measures

Continuing with its quest to eradicate patent infringement on Amazon, Canon has filed more Report Infringement Forms, as well as announcing the granting of another preliminary injunction in Germany.
Canon has revealed that it has filed a Report Infringement Form with Amazon Italy, based on the alleged use of claims 1 and 2 of the Italian portion of Canon’s European Patent EP 1 977 289 regarding the cartridge model “CB540A” offered by LD Products Inc. under the ASIN B0721YWXTM.
Following the filing of the form, Amazon took down the respective product.
Canon also filed a Report Infringement Form with Amazon ES based on the alleged use of claims 1 and 2 of the Spanish portion of Canon’s European Patent EP 1 977 289 the cartridge models “CB540A” and “CB542A”offered by magic-stores.biz UG under the ASINs B071JMDLL6 and B071G1JY93. Afterwards, Amazon also took down the respective products.
These products mentioned in the Report Infringement Forms are compatible with the OEM HP cartridge models and consist of a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289.
Furthermore, Canon explains, they comprise an elastic portion according to claim 2 of EP ‘289.
The OEM goes on to declare, “Filing a Report Infringement Form with Amazon is a service offered by Amazon and does not comprise any official finding of validity or infringement of a patent. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon.”
Amazon informed the vendors about the takedown; they have the opportunity to object to it.
In other legal developments, Canon also announced that the District Court Düsseldorf granted a preliminary injunction against Doree Supplies B.V., doing business as “AppleToner,” as well as against its managing directors. The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407 relating to a drum unit and a process cartridge. The preliminary injunction enjoins Doree Supplies B.V. from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, via, for example, www.amazon.de. The infringing cartridge can replace the OEM cartridge model HP CF280A which is compatible with HP laser beam printers.
Defendants have the option to file an objection against the preliminary injunction. However, as service on Defendants was effected, Canon can enforce this decision.
