Brother sued for patent validity it used for Amazon takedowns

E-Z Ink Inc. and other plaintiffs have filed a complaint with the United States District Court Eastern District of Virginia, Alexandria Division, seeking declaratory judgment of invalidity and unenforceability of a United States Patent owned by Brother Industries, Ltd.

E-Z Ink Inc., Zhuhaiaikedamaoyiyouxiangongsi (Akda), Imagetech Direct Inc., Lemero and Plenty Talent Corp. filed a complaint seeking a declaratory judgment that U.S. Patent No. 8,867,932 (the ’932 patent) is invalid and a declaratory judgment that the ’932 patent is unenforceable due to Defendant’s inequitable conduct before the United States Patent and Trademark Office (“USPTO”).

The complaint claims that Brother submitted notices of infringement to Amazon.com asserted claim 1 of the ’932 patent against the plaintiffs which caused the companies’ Amazon listings for printer toner cartridges to be taken down and resulted in a loss of business.

The plaintiffs demand a jury trial.
