Another cartridge removal triplicate from Canon

The OEM has announced the filing of further Report Infringement Forms with Amazon, requesting more toner cartridge removals.

Two of these forms were filed with Amazon UK.

The first is based on the alleged use of claims 1 and 2 of the UK portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge models “CE320A”, “CE321A”, “CE322A”, “CE323A”, “CB540A”, “CB541A” and “CB543A” offered by Consumable Direct Limited under the ASINs B00IK0J7SI, B007Y5ODKC, B007Y5OK3M, B007Y5OH1W, B00IK0IVX0, B00IK0IWM0 and B007XTYUA2. Afterwards, Amazon took down the respective products. They are compatible with the OEM HP cartridge models “CE320A”, “CE321A”, “CE322A”, “CE323A”, “CB540A”, “CB541A”, “CB543A” and comprise a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.

The second form is based on the alleged use of claims 1 and 2 of the UK portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge models “CC530A”, “CC531A”, “CC532A”, “CC533A”, “CB540A”, “CB541A”, “CB542A” and “CB543A” offered by G&Z TRADING LTD under the ASINs B015NESPFO, B015NESQ5S, B015NESS92, B015NESR8Y, B015NERHYO, B015NENTGO, B015NENUUE and B015NENU72. Amazon removed the products concerned. These products are compatible with the above OEM HP cartridge models “CC530A”, “CC531A”, “CC532A”, “CC533A”, “CB540A”, “CB541A”, “CB542A”, “CB543A” and provide a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. In addition, they comprise an elastic portion according to claim 2 of EP ‘289.

The third form Amazon filed was with Amazon Italy and is based on the alleged use of claim 1 and 25 of the Italian portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by Punto Rigenera S.R.L. under the ASIN (Amazon Standard Identification Number) B00OST3WWM. Amazon also removed these products, which are compatible with the OEM HP cartridge model CE505X and provide a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

The vendors were informed by Amazon and may object to the removals.
