The company has announced the conclusion of a toner cartridge-related patent infringement disputes in China.
Canon today announced the resolution of patent infringement disputes against Shanghai Sinocopy Industrial Co., Ltd. (上海勤科实业有限公司) and Zhongshan Sinocopy Electronic Co., Ltd. (中山华印电子科技有限公司. Shanghai Sinocopy Industrial Co., Ltd. and Zhongshan Sinocopy Electronic Co., Ltd. are hereinafter collectively referred to as Sinocopy) in Shanghai Intellectual Property Court of China, concerning certain toner cartridges sold for use in various models of HP laser beam printers.
In 2022, Canon filed a lawsuit, before Shanghai Intellectual Property Court of China, against Sinocopy for infringement of Chinese invention patent no. ZL200780002318.1 owned by Canon, mainly targeting their manufacturing and selling of certain toner cartridges.
In 2024, the Shanghai Intellectual Property Court of China made a judgment finding that Sinocopy’s THCE410X-THCE413A, THCE320A-THCE323A, THCF380X-THCE383A, THCC530A-THCC533A, THCF210X-THCF213A, and THCB540A-THCB543A models infringed the patent. Sinocopy filed an appeal against the first instance judgment.
Thereafter, Canon and Sinocopy reached a settlement agreement, wherein Sinocopy has agreed to stop infringement upon the patent and to pay Canon an undisclosed sum as part of the settlement.
In addition, based on the settlement agreement, Sinocopy has already withdrawn the appeal, and the first instance judgement has been taking effect since then.
