Epson files trademark complaint against two Amazon resellers

Epson accuses two more Amazon resellers of infringing Epson trademarks.

Epson (Seiko Epson Corporation and Epson America, Inc.) filed their complaint in the United States District Court Central District of California on February 24, 2021, accusing two more Amazon resellers of trademark infringement.

In court papers seen by The Recycler, Epson states that they “bring this action to combat the widespread infringement of their trademark rights”. Epson filed the complaint against two Amazon resellers Thomas Nelson d/b/a Seller Account TM Nelsons and Ganter d/b/a Seller Account GANTERY.

According to Epson’s complaint the defendants are allegedly marketing the ink cartridges, and bottles as new, genuine Epson products, which Epson says deceives the consumer and with “their poor quality is incredibly damaging to Plaintiffs’ name and reputation.”

Epson goes on to allege that the defendants operate through Amazon’s marketplace platform and “also use a variety of Amazon services to avoid detection while benefitting from Amazon’s high market visibility and business services.”

Epson’s claims include trademark infringement, unfair competition and false advertising. Epson is seeking a permanent injunction against the defendants; for the product to be destroyed; and for defendants to pay treble damages.
